Our
Natural Resources projects involve sand & gravel
operations, national forests, ground water recharge
facilities and flood control structures and districts.
Work for our natural resources clients focuses mainly on
two areas: Project Initiation and Reclamation. On the
front-end of our natural resource projects, we advise
clients on the NEPA environmental assessment and
environmental impact study process, on permit
requirements and on applicable legal requirements from
such federal laws as the National Historic Preservation
Act, the Endangered Species Act or Wilderness Act. The
Firm also advises clients on issues related to
compliance with Maricopa County flood control and
fugitive dust regulations, municipal zoning ordinances
and designations and "jurisdictional determinations" for
permitting and regulation under Section 404 of the Clean
Water Act . We also draft access agreements, easements,
rights-of-way and indemnification agreements. Once
active operations cease, the Firm also advises our
natural resources clients regarding the development of
and compliance with reclamation plans and financial
assurance mechanisms.
