The Firm provides its expertise in drafting, reviewing,
negotiating, implementing and enforcing contract terms
and conditions in both environmental and general law
matters.
Ms.
Mangone is known nationally for her work on numerous
high-profile, high value environmental settlements. In
1995, Nancy and her colleagues at EPA and the Department
of Justice were awarded the National Superfund Team of
the Year in recognition of their comprehensive and
innovative settlement of the complex liability and
cleanup issues surrounding the California Gulch
Superfund Site in Leadville, Colorado. She has also been
EPA's lead attorney on the Eagle Mine Superfund Site
consent decree, and a series of settlement agreements
related to the Smuggler Mine Superfund Site in Aspen,
Colorado and the Summitville Mine Superfund Site in Del
Norte, Colorado. The aggregate value of these
settlements is estimated at more than $200 million.
More recently, Nancy has represented the City of
Goodyear in its negotiations with Crane Co. on the
Supplemental Environmental Projects Agreement related to
the Phoenix-Goodyear Airport North Superfund Site. Under
the terms of this Agreement, Crane is funding a $1
million Brownfield inventory, characterization and
remediation program. She also represented Navopache
Electric Cooperative in the drafting and negotiation of
a de minimis settlement under the Texas Solid Waste Act.
Navopache, an Arizona-based public utility, agreed to
pay response costs (and a premium) to the SESCO Working
Group, the party performing the remedial action for the
San Angelo (TX) Superfund Site.
While the Firm focuses on environmental issues, Ms.
Mangone has spent the last 20 years honing her skills in
the fine art of drafting and negotiating contract terms
in many contexts. She has reviewed, commented on and
drafted real estate transaction agreements, development
agreements, employment contracts and indemnification
agreements. When necessary to protect her clients'
interests, she has also brought or defended against
actions in State court to enforce the terms of these
contracts and/or sought damages for breach of contract.
