Ms. Mangone represents parties in Arizona and Colorado trial courts for a variety of contract-related claims. Some representative cases include:
Cropley, et al. v. Recreation Centers of Sun City, Inc. The Firm brought a Class Action lawsuit in Maricopa County Superior Court on behalf of 81 homeowners living on the shores of Viewpoint Lake in Sun City, Arizona, after the Defendant, RCSC, sought to raise the homeowners' annual lake maintenance fees by 340 per cent. Defendant RCSC must abide by a 30-year old contract that established the annual maintenance fee increase formula. The Class prevailed on Summary Judgment and RCSC was prohibited from imposing its rate increase or from decreasing the amount of maintenance it performs on the Lake.
Brooks v. Young. In this forcible detainer/eviction proceeding, plaintiffs sought possession of a mobile home and $10,000 in back rent. Ms. Mangone obtained a Judgment from the North Valley Justice Court which denied plaintiffs any monetary award for back rent and ordered removal of the mobile home from the defendant's property.
A Better Connection, Inc. v. Matthew Doherty. This breach of contract case was brought against Doherty, a minor, for breach of his employment contract and for breach of an alleged fiduciary duty to protect his employer's trade secrets under the Arizona Trace Secrets Act. The case ended by settlement and stipulation, with neither the parties receiving an award.
She also previously represented clients in the following general litigation matters:
Paul Braunstein dba BasePlans USA v. State of Arizona. Ms. Mangone successfully defended the Arizona Department of Transportation in this challenge to the State's award of the design and construction contract to build a portion of the Maricopa County Freeway System. The case against ADOT was dismissed on Summary Judgment, based on the legal theories of res judicata and collateral estoppel. In addition to drafting pre-trial motions and pleadings and presenting oral arguments before the Court, this case involved extensive review of "public records" for legal privileges, to protect them from disclosure.
The Town of Wickenburg. Ms. Mangone has represented the Town of Wickenburg in two matters: a referendum petition case captioned Committee for the Preservation of Neighborhoods v. Riffel, Supreme Court No. CV-06-0336-PR, and a breach of contract dispute with Down to Earth Contractors, Inc. (DTE) (CV2005-070721). In the referendum case, the Supreme Court of Arizona ultimately denied the Appellant's Petition for Review requesting certiorari; the breach of contract action was settled and dismissed with prejudice, without any payment being made by either party.
Mohave Electric Cooperative. In an action brought against Mohave Electric by the United States Bureau of Indian Affairs, Docket No. E-0175A-05-0579, Ms. Mangone drafted and filed an Answer and various procedural and dispositive motions with the Arizona Corporation Commission on the electric cooperative's behalf.
